Terms of Use and Privacy Policy
Introduction
The National Ski Areas Association (NSAA) is committed to providing its members with information while protecting their privacy and respecting confidentiality. NSAA provides this notice explaining its policies for data collected through the Internet, the use of NSAA’s websites, mobile applications and similar digital platforms, virtual and in-person educational seminars, and other means.
About NSAA
NSAA is the trade association for ski area owners, operators, suppliers, and other ski industry organizations. It represents more than 300 alpine resorts that account for more than 90 percent of the skier/snowboarder visits nationwide. Additionally, it has more than 400 supplier members who provide equipment, goods and services to the mountain resort industry. As part of its mission, NSAA analyzes and distributes ski industry research and analysis; produces annual and regional conferences and tradeshows; produces periodic industry publications and research reports and is active in state and federal government affairs. The association also provides educational programs and employee training materials on industry issues, including ski safety, OSHA, ADA and NEPA regulations and compliance; environmental laws and regulations; state regulatory requirements; aerial tramway safety; and resort operations and guest education. The association's primary objective is to meet the needs of ski area owners and operators nationwide and to foster, stimulate and promote growth, safety, and sustainability across the industry.
Prohibition on Recording
THERE IS ABSOLUTELY NO ELECTRONIC OR DIGITAL RECORDING ALLOWED AT NSAA CONFERENCES, WEBINARS, SEMINARS, OR OTHER RELATED INFORMATION!
NSAA seeks to foster an open and candid exchange of ideas between ski area personnel with its educational seminars. Accordingly, NSAA strictly prohibits any recording – including any audio, visual, or digital recording of any kind – of any of the sessions, meetings, speakers, or individual attendees at NSAA meetings and conferences, notwithstanding local or state laws unless given consent. This prohibition also extends to using A.I./Artificial Intelligence. You are prohibited from sharing this information outside of your ski area, without prior consent from NSAA.
It is also NSAA policy that individuals may not attend any session or meeting without being registered for the conference. NSAA meetings and conferences are not public forums. As noted in registration materials, NSAA will seek civil and criminal penalties, as well as damages and attorney’s fees, if a person violates this policy. By registering for any NSAA event, you hereby agree to be bound by these policies.
NSAA Websites and Applications
NSAA currently operates the following websites and mobile applications to which this policy applies (and may extend to other digital properties developed in the future):

In addition, NSAA owns several other domain names that point to the websites listed above. From time to time, NSAA may add new sites that may not be listed above but will provide a link to this policy.
NSAA Data Management
NSAA maintains strict protocols in the management of its data, including its members’ data and members’ sensitive data it collects as part of NSAA’s research mission. Any suspected abuse of NSAA’s privacy and confidentiality policy should be reported to NSAA Data Management at the contact listed below.
- NSAA manages many of its company email transmissions through MailChimp, an email marketing company that maintains extremely high anti-spam standards and data security protocols. http://www.mailchimp.com/
- NSAA manages all of its membership data internally, with comprehensive data security protocols.
Providing Information to NSAA
Any persons or company providing information to the NSAA does so voluntarily, whether as a member of NSAA, or anyone from the general public. NSAA strictly maintains such information with strict confidentiality and does not release individual resort or supplier data to anyone, although NSAA does release certain data in a strictly aggregated, non-identifiable form. Although information may be required to participate in some of NSAA’s programs, events, or product sales, participants and NSAA members provide that information voluntarily to NSAA. NSAA collects information in conjunction with, including, but not limited to, the following services:
- Registering as a member of the NSAA
- Purchasing products or services from the NSAA
- Participating in the NSAA educational events and/or tradeshows, including local and regional industry events, whether in-person or virtual
- Communicating by any other means to NSAA, including visit NSAA websites, applications, and related digital platforms
- Research projects, reports and surveys
The collection of personal information for these services may include your name, address, telephone number, email, and/or credit card information. NSAA needs to collect this information for management of its educational events and/or tradeshows, fulfilling purchases, providing requested communications, website tracking and “cookies” and other online-use information capture, verifying compliance with NSAA's policies and federal, state and local laws, and for feedback solicitation purposes.
NSAA adheres to strict data management and data security protocols. Those protocols vary based on the category of participation with NSAA, as indicated below.
NSAA Members
NSAA may share personal information including name, address, job titles, phone numbers, email address, and attendance at NSAA events, to NSAA-registered ski area members and suppliers. Credit cards or any other financial information is never shared under any circumstances. NSAA members have the right to opt-out of any communications from NSAA by contacting NSAA Member Services. Any suspected abuse of this usage should be reported to NSAA Data Management at the contact listed below.
Use of IP Addresses
An IP address is a number that is automatically assigned to your computer whenever you're surfing the Web, allowing your computer to possibly be identified. NSAA collects IP addresses for a variety of purposes, including but not limited to, system administration, monitoring traffic and visitation, reporting aggregated information, monitoring potential fraud or abuse, and auditing the use of its sites. NSAA can and will use IP addresses to identify a user when it is necessary to address and enforce compliance with NSAA rules and codes of conduct, terms of service, compliance with legal process, or to protect its services, sites, customers or others.
Use of Cookies
To enhance users’ experience, many web pages and related digital platforms on NSAA’s sites utilize "cookies." Cookies are text files placed in your computer browser to store your preferences. Cookies, by themselves, do not provide NSAA with your email address or other personally identifiable information, unless you choose to provide this information to NSAA in other ways, by, for example, registering on the site or participating in any of the services or events offered by NSAA. However, once you choose to furnish the site with personally identifiable information, this information may be linked to the data stored in the cookie. The use of cookies is an industry standard – you'll find them at most major web sites. NSAA may use the information from cookies to provide services better tailored to users’ needs. By accessing any NSAA website, app, or other digital platforms, you fully consent and voluntarily allow NSAA to capture any of this digital information, notwithstanding local, state, or federal laws on privacy, data use, or other information capture regulations, and you further waive your right to participate in any class or collection action lawsuits against NSAA related to any privacy claims, data sharing, or other digital access compliance and regulatory claims.
Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, note that some parts of NSAA's online services will not function properly or may be considerably slower if you refuse cookies. You may occasionally get cookies from advertisers, sponsors, internet providers, or any other third-party business partners. The use of advertising cookies sent by third-party servers is standard in the Internet industry. NSAA does not control or take responsibility for these cookies, and you fully consent and voluntarily allow NSAA to capture any of this digital information.
Links to Other Sites
Some of NSAA’s sites contain links to other sites whose information practices may be different. For example, if you "click" on a linked banner advertisement, the "click" may take you off the NSAA site(s). This includes links from sponsors and partners that may use the NSAA logo as part of a co-branding or other agreement. These other sites may send their own cookies to guests, collect data, or solicit personal information. NSAA endeavors to link to sites that meet similar standards for maintaining each individual's right to privacy, but NSAA cannot guarantee or ensure that such links achieve similar privacy standards as NSAA. Moreover, NSAA cannot control any of these links and is not responsible for any content appearing on sites linked to or from NSAA site(s), or for any personal information gathered at those sites. Guests should consult the other sites' privacy notices, as NSAA has no control over information that is submitted to, or collected by these third parties. Children 13 and under should get parental permission before linking to other sites.
European Economic Area Resident Rights
All NSAA websites are hosted outside the European Economic Area. The information you provide is transmitted to the United States of America and is stored and processed in the United States of America.
If you are a resident of the EEA, when we process your personal data, we will only do so when we have a legitimate interest in processing your information. For example, we may process your personal data to communicate with you about changes to our services; to provide, secure, or improve our services; or to process your order through the NSAA online store or registration for an NSAA event. - In addition, you can object to processing of your personal information, ask us to restrict processing of your personal information or request portability of your personal information. - If we have collected or processed your personal information with your consent, you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Security
The importance of security for all personally identifiable information associated with NSAA’s members is one of NSAA’s priorities. NSAA exercises great care and invests significant resources in providing secure transmission of your information from your computer to NSAA’s servers. Unfortunately, no data transmission over the Internet can be guaranteed to be 100-percent secure. As a result, while NSAA strives to protect your personal information, it cannot ensure or warrant the security of any information you transmit to or from NSAA’s online products or services, and you proceed with the use of NSAA websites and digital platforms at your own risk. Once NSAA receives your transmission, NSAA makes its best effort to ensure its security on its systems. When credit card information is transmitted, NSAA and its service partners use industry-standard SSL (secure socket layer) encryption.

YOU ARE VOLUNTARILY AGREEING TO WAIVE YOUR RIGHTS TO PURSUE ANY CLAIMS IN COURT, OR IN A CLASS ACTION LAWSUIT, AND AGREE TO PURSUE ANY CLAIMS THROUGH ARBITRATION. IN ARBITRATION, UNDER THE TERMS OF THE FEDERAL ARBITRATION ACT (FAA), YOU WILL STILL HAVE THE RIGHT TO PURSUE LEGAL CLAIMS UNDER STATE OR FEDERAL LAW, BUT YOU DO NOT HAVE THE SAME RIGHTS IN ARBITRATION AS IN STATE OR FEDERAL COURT. UNDER THE FAA, THE PREVAILING PARTY IN ARBITRATION MAY SEEK TO SHIFT ALL RELATED COSTS OF ARBITRATION, PURSUANT TO THE FAA, TO THE NON-PREVAILING PARTY.
Your Acceptance of These Terms
By using NSAA’s web site(s), or registering to participate in any of its programs, you acknowledge your assent to and understanding of NSAA's Privacy Policy, and you fully accept these terms of use in this agreement herein. If you do not agree to this policy, please do not use NSAA site(s), or register to participate in any of its programs. NSAA reserves the right to delete information or to change or update its privacy policies at any time. Your continued use of this site following the posting of changes to these terms will mean you accept these changes and terms.
